Terms of Use

Last updated: 13 October 2026

These terms are the agreement between you and us about using Portiva. We have kept them as short and plain as we can. Please read them, especially the parts about health, AI estimates and subscriptions.

1. Who we are

These Terms of Use (“Terms”) are an agreement between you and Portiva (“Portiva”, “we”, “us”). They cover the Portiva app for iPhone and Apple Watch, its widgets and the services behind them (together, the “Service”).

By downloading or using Portiva, you agree to these Terms. If you don’t agree, please don’t use Portiva. Our Privacy Policy explains how we handle personal data.

2. The service

Portiva helps you log food, drinks, water, weight, fasting, medication doses and activity; estimates calories and nutrients; suggests calorie and macro targets; and offers optional AI features: logging by photo, live camera scan, voice or text, nutrition label reading, an AI coach and meal plans.

Some features need a paid plan, an internet connection, Apple Health, an Apple Watch, an account or your consent to AI processing. The free plan has limits, for example one AI log a day. We keep improving Portiva and may add, change or remove features. If we remove a major feature of a paid plan, we will tell you in advance.

3. Who can use Portiva

You must be at least 16 years old to use Portiva. If you are under 18, use Portiva only with the permission of a parent or guardian, and talk to a doctor before changing your diet.

Portiva is not designed for people with, or recovering from, an eating disorder. If that applies to you, please use it only with the guidance of a health professional.

4. Not medical advice

  • Portiva gives general information about nutrition and activity. It is not a medical device, and it doesn’t diagnose, treat, cure or prevent any disease. It doesn’t replace a doctor, dietitian or pharmacist.
  • Targets are based on general formulas and your own logs. Weight loss, or any other result, is not guaranteed.
  • If you are pregnant or breastfeeding, under 18, have a history of eating disorders or a condition such as diabetes, or take medication such as a GLP-1, talk to your doctor or dietitian before changing your diet.
  • GLP-1 mode only helps you keep your own records of medication your doctor prescribed. It never recommends, starts, stops or changes a dose.
  • Ramadan mode calculates imsak and iftar times for your location. Follow your local religious authority for exact times.
  • If you feel unwell, contact a doctor. In an emergency, call your local emergency number.

5. AI estimates

  • AI features produce estimates, and estimates can be wrong. Hidden oil, butter, sauces, sugar and portion sizes are the most common errors. Check each item and portion before you save it, and correct anything that’s off.
  • Values from nutrition labels, barcodes, food databases and other users can also contain mistakes. When accuracy matters, check the package.
  • Don’t rely on Portiva for allergen or intolerance information. Always check ingredients yourself.
  • The AI coach and meal plans are general suggestions, not personal medical or dietary advice. They don’t know everything about your health.
  • AI features run only after you give explicit consent, and send data to our AI provider as described in the Privacy Policy.
  • “Unlimited” means unlimited for normal personal use. To prevent abuse, paid plans have daily technical caps well above normal use (currently 100 AI meal logs, 200 coach messages and 10 meal plans a day).

6. Your account

You can use Portiva without an account. If you create one with Sign in with Apple or Google, keep that Apple or Google account secure, because it is the key to your Portiva account. An account is for one person; don’t share it or use someone else’s. You can delete your account at any time in the app (Profile › Account › Delete account).

7. Subscriptions and payment

  • Plans. Portiva has a free plan and paid plans (Plus and Pro). What each plan includes is shown in the app before you buy. The price shown is the amount billed for each period, including any taxes the App Store applies.
  • Payment through Apple. Subscriptions are sold through the Apple App Store and charged to your Apple Account. Apple’s Media Services Terms and Conditions also apply to your purchase.
  • Auto-renewal. A subscription renews automatically at the end of each period (monthly or yearly) at the then-current price, unless you turn off auto-renew at least 24 hours before the current period ends. Apple charges your Apple Account within the 24 hours before the period ends.
  • Managing and cancelling. Manage or cancel in your iPhone’s Settings › [your name] › Subscriptions, or from Profile › Manage subscription in the app. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Deleting the app or your account does not cancel a subscription.
  • Free trials. A 7-day free trial is available only on the yearly Plus and Pro plans, for eligible Apple Accounts. If you don’t cancel at least 24 hours before the trial ends, it becomes a paid yearly subscription and the yearly price is charged. We remind you before a trial ends.
  • Price changes. If a price changes, Apple tells you in advance and, where required, asks for your consent before the new price applies.
  • Refunds. Apple processes all payments, so refunds are requested from Apple at reportaproblem.apple.com and decided under Apple’s policies. If you live in the EU or the UK, you may have a legal right to withdraw from a purchase; Apple handles withdrawals for App Store purchases. Nothing in these Terms limits your rights as a consumer.
  • Restoring purchases. On a new device, use Restore on the plans screen with the same Apple Account, or sign in to the same Portiva account.

8. Your content

You own what you put into Portiva: your logs, photos, recipes, notes and messages. You give us permission to store, process and transmit that content only to provide the Service to you, for example to back it up or to send it for AI analysis when you ask, as described in the Privacy Policy. Only upload content you have the right to use.

9. Community product contributions

If you have an account, you can share a packaged product you add (barcode, name, brand, nutrition values and serving sizes) with everyone.

  • Licence. When you share a product, you give us a worldwide, royalty-free, non-exclusive licence to use, store, copy, adapt (for example, combine it with other people’s entries), publish and share it in the Service and with other Portiva users. The licence lasts as long as the contribution is in the Service. When you delete your account, your entries are removed, but product values already combined with other people’s entries may remain, with no link to you.
  • What you may share. Only product information that is accurate and read from the actual package or a source you are allowed to use. Don’t share content that infringes someone else’s copyright, trademark or other rights, such as text or images copied from websites or databases whose terms forbid it.
  • What you may not share. Personal data, links, advertising, or offensive or misleading names.
  • Moderation. We may check, edit, merge, hide or remove contributions. Shared values come from users and may be wrong; check the label when it matters.

10. Acceptable use

Please don’t:

  • break the law or anyone’s rights while using Portiva;
  • bypass limits, quotas or security, for example by resetting device identifiers to get more free AI logs;
  • access our servers other than through the app, or use bots, scrapers or other automated means;
  • overload, disrupt, probe or attack the Service;
  • copy, decompile or reverse engineer the app, except where the law allows it;
  • resell the Service or use its outputs commercially;
  • use the AI features to create unlawful, harmful or abusive content;
  • upload malware or content that infringes others’ rights;
  • use Portiva to encourage dangerous eating behaviour.

11. Our rights in Portiva

The app, its design, text, food catalog and software belong to us or our licensors. We give you a personal, non-commercial, non-transferable licence to use the app on Apple devices that you own or control, as allowed by the App Store’s usage rules. These Terms don’t give you any other rights in Portiva, its name or its logo.

12. Food data sources and credits

13. Ending your use

  • You can stop using Portiva and delete your account at any time.
  • We may suspend or end your access if you seriously or repeatedly break these Terms, if your use puts others or the Service at risk, or if the law requires it. We will tell you why, unless the law or security reasons prevent it.
  • If we stop offering Portiva altogether, we will give you at least 30 days’ notice and a way to export your data. Refunds for paid periods are handled by Apple under its policies and the law.
  • Sections that by their nature should continue (for example, sections 9, 11, 14 and 17) continue after your use ends.

14. Disclaimers and limits of liability

  • We work hard to keep Portiva accurate and available. To the extent permitted by law, Portiva is provided “as is” and “as available”, and we don’t promise that it will always be available or error-free, or that estimates will be accurate.
  • To the extent permitted by law, we are not liable for indirect or consequential losses, or for decisions you make based on estimates or suggestions in Portiva. We are not responsible for data that is only on your device and is lost because you didn’t back it up.
  • To the extent permitted by law, our total liability for claims about the Service is limited to the amount you paid for your Portiva subscription in the 12 months before the claim.
  • Nothing in these Terms limits our liability for intent or gross negligence, for death or personal injury caused by our negligence, or any other liability that cannot be limited by law, and nothing limits your statutory rights as a consumer.

15. App Store terms

If you got Portiva from the Apple App Store, the following also applies:

  • These Terms are between you and us only, not Apple. We, not Apple, are responsible for Portiva and its content.
  • Your licence to use the app is limited to Apple-branded products that you own or control, as permitted by the usage rules in the Apple Media Services Terms and Conditions.
  • We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to conform to a warranty are our responsibility, to the extent not excluded by these Terms.
  • We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws, including in connection with Apple Health (HealthKit).
  • If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must follow applicable third-party terms when using the app, for example your mobile data agreement.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
  • Questions, complaints or claims about the app: Portiva, support@portiva.app.

16. Changes to these terms

We may update these Terms when Portiva or the law changes. The date at the top shows the current version. We will tell you in the app before an important change takes effect, at least 30 days in advance if the change is to your disadvantage. If you keep using Portiva after a change takes effect, the new Terms apply. If you don’t agree, you can stop using Portiva and cancel your subscription.

17. Governing law and disputes

  • Talk to us first. If something goes wrong, email support@portiva.app. Most problems can be solved quickly, and we will try to resolve yours informally before anyone goes to court.
  • Your consumer rights always apply. If you use Portiva as a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts or before the consumer bodies where you live. Nothing in these Terms takes those rights away.
  • Everything else. Subject to those mandatory rights, these Terms are governed by the laws of the place where Portiva is established, without regard to its conflict-of-law rules.
